Odie Henderson December 23, 2019 “Just Mercy” has the misfortune of hitting theaters at the same time as “ Clemency, ” a more daring and better film set on a prisons Death Row. Though the lead characters differ in intent? Michael B. Jordan s activist Bryan Stevenson is trying to get prisoners off the row while Alfre Woodard s warden Bernadine Williams oversees their executions?the two actors each have moments of stillness where they seem to physically vibrate from the internal trauma theyre suppressing. This is built into Woodards character intrinsically, but for Jordan, it feels more like an actor doing his best to rise above the paper-thin characterization he has been given. Stevenson is so noble and flawless that hes a credible bore unless you focus on Jordans physicality. You look into his eyes and see him trying to play something the films cautious tone wont allow: a sense of Black rage. Advertisement Since the days of '50s-era message pictures, the majority of films about African-American suffering have always been calibrated the way “Just Mercy” is, with an eye to not offending White viewers with anything remotely resembling Black anger. We can be beaten, raped, enslaved, shot for no reason by police, victimized by a justice system rigged to disfavor us or any other number of real-world things that can befall us, yet God help us if a character is pissed off about this. Instead, we get to be noble, to hold on to His unchanging hand while that tireless Black lady goes “hmmm-HMMMMM! ” on the soundtrack to symbolize our suffering. Theres a lot of “hmmm-HMMMMM”-ing in this movie, so much so that I had to resist laughing. These clichés are overused to the point of madness. Between this, the equally lackluster “ Harriet ” and the abysmal “ The Best of Enemies, ” that poor womans lips must be damn tired from all that humming. Movies like “Just Mercy” spoon-feed everything to the viewer in easily digestible chunks that assume you know nothing, or worse, dont know any better. They believe that, to win the hearts and minds of racists, you cant depict any complexity lest you ruin the “teachable moment” the film is supposed to be presenting. Its unfortunate that these teachable moments are so often delivered in the exact same, tired manner, as if they were meant for people who are perpetually having to repeat the same grade. Making matters worse, the White perpetrators of injustice are so often one-note villains that they allow for plausible deniability by the viewer: “I cant be racist because Im nowhere near as bad as THAT guy! ” Granted, this is a period piece true story and the film cant bend its real-life people too deeply into dramatic license, but director and co-writer Destin Daniel Cretton applies a way-too-familiar formula to their personalities. Despite my complaints, I have some admiration for how much “Just Mercy” is willing to interrogate. Its a lot, and I feel some commendation is in order for bringing these issues up at all. Adapting Stevensons memoir, Cretton and his co-writer Andrew Lanham touch upon activists for Death Row prisoners, the value of White lives vs. Black lives, veterans whose PTSD is left unchecked, corrupt law officials, justice system imbalances and, in a subplot anchored by Tim Blake Nelson, the idea that poor people are victimized by law enforcement regardless of what color the impoverished person is. I remember watching the “60 Minutes” profile re-created here, where Stevenson takes the case of Walter McMillian ( Jamie Foxx) to the public. McMillian was on Death Row for a crime he swore he didnt commit, the death of a young White woman. Despite having 17 witnesses vouching for his whereabouts at the time of the murder, an Alabama jury of 11 White men and one Black man convicted McMillian based on the testimony of an ex-con named Ralph Meyers (Nelson. Stevenson took his case to the CBS airwaves after his successful attempt to get McMillians case reopened ended with a judge named after Robert E. Lee discarding Myers admission that hed lied under oath in the first trial. All of this is completely believable in reality, but here, both the corrupt Sheriff Tate ( Michael Harding) and the district attorney are depicted as cartoon villains acting alone rather than in service to a far more racist and corrupt system. You have to wait until midway through the closing credits to discover that Tate was re-elected multiple times after his role in McMillians railroading was exposed. I should mention that this case took place in Monroeville, Alabama, also known as the home of “ To Kill a Mockingbird ” author Harper Lee. I bring up Lee because her book, and its subsequent cinematic adaptation, are ground zero for all the aggravating clichés I mentioned above. So its no coincidence that “Just Mercy” plugs Michael B. Jordan into the Atticus Finch role. Like Gregory Peck in that immortal performance, Jordan has presence, idealism and righteousness on his side. Whats missing is the commanding sense of authority Peck brought to the part, which isnt Jordans fault at all. Stevenson is a somewhat naïve Yankee from Delaware trying to navigate the ways of the Deep South; Finch was an Alabama native with a paternal glow. As Stevensons co-worker Eva, Brie Larson reteams with her “ Short Term 12 ” director but is given little to do other than to be threatened once she re-opens McMillians case. Still, she milks a lot of character out of the simple act of smoking a cigarette. Foxxs McMillian is written in a similarly flat manner, but he shines in his few scenes with fellow Death Row inmate Herbert Richardson ( Rob Morgan. Richardsons arc is the one truly successful element of “Just Mercy, ” and Morgans excellent, heartbreaking performance is being unfairly overshadowed by Foxxs this awards season. A Vietnam vet with severe PTSD, Richardson caused the death of a young girl when a bomb he planted on her porch exploded. Unlike McMillian, Richardson is guilty of the crime and believes he belongs on Death Row. He was unable to get help for his mental issues before he committed his crime, and the prosecutor withheld this information during the trial. Morgan shades his small part with such beautiful, subtle gestures that he becomes the only character who feels fleshed out, complex and real. You feel not only his sense of guilt but the demons that infected his brain during combat. His last, horrific scene is so well acted that it still haunts me; its the only time the viewer is forced to be uncomfortably conflicted, to think about the complicated nature of injustice. McMillian, an African-American man who was convicted of the 1986 murder of Ronda Morrison. Bryan looks over the evidence in the case and discovers it hinges entirely on the testimony of convicted felon Ralph Myers, who provided a highly self-contradictory testimony in exchange for a lighter sentence in his own pending trial. Bryan's first move is to ask prosecutor Tommy Chapman for aid, but Chapman dismisses him without even looking at his notes. Bryan next asks McMillian family friend Darnell Houston to testify that he was with a witness who corroborated Myers' testimony the day of the murder, which would cause the prosecution's case to fall apart. When Bryan submits Darnell's testimony, police arrest him for perjury. While Bryan is able to get the perjury charges dismissed, Darnell is intimidated into refusing to testify in court. Bryan then approaches Myers himself, who eventually admits that his testimony was coerced after police played to his fear of burning and threatened to have him executed by electric chair. Bryan Stevenson, Just Mercy: A Story of Justice and Redemption Attorney Bryan Stevenson (Michael B. Jordan) is the model of perseverance as he defends in the late '80's Walter McMillian, a black man in Alabama (To Kill a Mockingbird's Monroeville, ironic enough) over corrupt murder charges. Although the arc of defense is usually the same in reality as well as this drama, Just Mercy, each incident will hit fair minded audiences in the gut each time. Director Dustin Daniel Cretton keeps the pace of Bryan's investigation apace, from the early days as a new Harvard trained lawyer to the journey to the Alabama Supreme Court and back. During that time the audience gets a stark reminder that standing up against bigotry and corruption (Alabama cops do not come off like justice driven officer) as Stevenson does is not for the weak, but definitely for those who seek justice, especially for underserved minorities. Although Walter having been unjustly convicted is established early on, it's the undoing of that conviction (Walter is awaiting his execution date) that provides suspense, with multiple incidents of denial in the court system. Meanwhile Stevenson (he wrote the account on which the film is based) gives a few too many Hollywood-like speeches about the prejudice that allows an innocent man to lose part or all of his life fighting a system that caters to the wealthy and the white. The strength of this predictable drama, unavoidable given the story is based on a real drama that is replayed in courtrooms daily, and it seems in the South more often than normal, is the depiction of helplessness for the unjustly convicted and the efficacy of tenaciousness joined to truth. The corrosion of justice and the heroism of humane people is on display and a reminder that never giving up is the antidote to hopelessness. Hope is the dominant motif of Just Mercy, and it's just and merciful.

I n an emotionally charged scene in the new movie Just Mercy, Jamie Foxx, cast as a death row prisoner named Walter McMillian, accosts the young lawyer who has taken up his case with an uncomfortable truth about being black in the deep south. “You dont know what youre into down here in Alabama, ” he warns. “Here youre guilty from the moment youre born. ” That phrase could stand as a catchphrase for the ingrained racial injustice that Bryan Stevenson, the rookie lawyer played in the film by Michael B Jordan, has devoted his adult life to fighting. From his first meeting with McMillian in 1988 to his star billing today as a one of Americas most incisive commentators on race and inequity ? and now as a fully fledged Hollywood icon ? Stevenson has never taken his eyes off the prize. His epic six-year struggle to prove McMillian an innocent man provides the narrative arc of Just Mercy. It is based on the 2014 memoir of the same name in which Stevenson, 60, relates how he came to find himself representing some of the most godforsaken prisoners in the country. He was 23 and a student at Harvard law school when his professor suggested he take an internship in Atlanta, Georgia, with a not-for-profit legal firm. The firms director, a towering figure in death penalty jurisprudence named Stephen Bright, took Stevenson under his wing and taught him justice, southern-style. Those existential doubts vaporised as soon as Bright dispatched Stevenson to Alabama to investigate its death row. “When Bryan started looking into what was down there, ye gods! It was horrible! ” Bright told the Guardian. “People were being sentenced to death in a perfunctory fashion represented by lawyers who had no idea what they were doing. ” Bright recalls his young charge returning from a prison visit in an excited state. “This man is innocent, ” Stevenson said. “I know he is innocent. ” The man in question was Walter McMillian who had been sentenced to death for the 1986 murder of an 18-year-old white woman. When Stevenson began looking into the case he was struck by a legion of inconsistencies and ironies. The main irony was that the murder happened in Monroeville, home town to Harper Lee, which just went to show how much Alabama had taken to heart the moral of To Kill A Mockingbird. Even before he got going on the case, the trial judge ? aptly named Robert E Lee Key ? tried to talk Stevenson out of it. “Why the hell would you want to represent someone like McMillian? ” the judge said. Undeterred, Stevenson began digging into the record and discovered that not only had McMillian been found guilty in a trial lasting all of two days, but the defendant had a rock-solid alibi with dozens of witnesses. The prosecution relied on a jailhouse snitch who was offered money and freedom to provide false testimony against him. Exposing the racial animus at the heart of the death penalty was not easy. There were bomb threats and many disappointments and legal setbacks along the way. But in 1993 McMillian was exonerated and walked free. Its a measure of the exceptional nature of Stevenson that just where the movie ends ? with the good guys winning their death row battle ? his own story begins to get all the more interesting. Stevenson has gone on, post-McMillian, to create an entire operation dedicated to uncovering miscarriages of justice in the deep south. Back in the 1980s he had a poky office and a single assistant; today the organisation he founded, Equal Justice Initiative, employs 140 people, many of them whip-smart lawyers in his own mould. EJI has won reversals or release from prison for more than 135 wrongly convicted prisoners. Among them was Anthony Ray Hinton, who like McMillian was proven innocent in his case after 28 years on death row. Having turned EJI into a justice powerhouse, Stevenson has switched his energies to what might well become the most significant aspect of his legacy. He is now emerging as a leading exponent of Americas racial fault-line in which he has begun to join the dots between slavery, racial segregation, terror lynchings of African Americans, capital punishment and the scourge of modern mass incarceration. He has taken his hands-on experience of southern brutality ? what he calls his “proximity to injustice” ? and extracted from it a philosophy of the open wound that runs through American society and politics. To do that he has drawn from his roots as the great-grandson of slaves in Virginia and his experiences growing up as a black child in a small, segregated town in rural Delaware. From regular attendance at his familys local black church he imbibed the preachers art of engaging an audience. You can see it in action in his Ted talk which has been viewed more than 6m times and which earned him one of the longest standing ovations in Teds history. He counted 59 Confederate markers glorifying the slave-owning south, while there was nothing to memorialise the suffering that the slave trade induced. In 2013, after a long tussle with local authorities, he managed to have three markers to the domestic slave trade erected in downtown Montgomery. From there it was but a short hop to thinking about the racial composition of death row. Why were Walter McMillian and Anthony Ray Hinton both black? Why are 42% of death row inmates today African American, when black people form just 13% of the US population? The culmination of these meditations is the National Memorial for Peace and Justice, Stevensons most breathtaking and audacious achievement yet. Through it he holds up a mirror to America of a central element of its character, one that until now has been almost entirely obscured ? its tragic history of lynchings of more than 4, 000 African Americans. The memorial, cast in bronze, sits on top of the hill that rises above Montgomery. Physically, and symbolically, it looks down on the Alabama State Capitol where so many of the political decisions that upheld white supremacy were taken ? and still are taken. Standing in the centre of the memorial the power of Stevensons unfolding vision is almost overwhelming. From Montgomerys slave warehouse and the thousands of men and women who died hanging from a tree, to Walter McMillian who came so close to a latter-day judicial lynching, this is Americas unfinished business, its truly strange and bitter fruit.

They gently and less gently suggest that as a native of Delaware with a northern education, he cant possibly understand the tenacity of white Southern habits of racial domination, which some of the white residents insist are not racist at all. McMillian himself, known to his family and neighbors as Johnny D (and played by Jamie Foxx) at first refuses Stevensons help. The injustice of his trial was so blatant that opposing it seems almost like a waste of time. Other lawyers have come and gone, taking money from Johnny Ds wife, Minnie (Karan Kendrick) and leaving him to languish on death row. The drama of “Just Mercy” is mostly procedural. Stevenson and his colleagues, including Eva Ansley (Brie Larson) work to establish Johnny Ds alibi and to challenge the testimony of a dubious witness (Tim Blake Nelson. Stevenson also runs up against the malevolent arrogance of the sheriff (Michael Harding) who led the investigation and the duplicity of the new district attorney (Rafe Spall) whose initial politeness turns to condescension and contempt. What is clear is that Stevenson isnt just challenging a single conviction, but also the deep legacies of slavery and Jim Crow. Like many of the lynching victims of the past, Johnny D threatened racial hierarchies, both because he was economically independent (owning a successful pulpwood business) and because of an affair he had with a white woman. His adultery is painful for Minnie and their children, and represents an unacceptable transgression of racial and sexual taboos to the sheriff and other white people. Jordan plays Stevenson as a man of heroic decency, but this kind of role comes with constraints. He is consistently admirable but not always dramatically interesting, and whatever fear, doubt or anguish he experiences in his work is telegraphed through speeches and music-heavy moments. His inner life is a territory the film leaves unexplored. “Just Mercy” is saved from being an earnest, inert courtroom drama when it spends time on death row, where it is opened up and given depth by two strong, subtle performances, from Foxx and Rob Morgan. Foxx, 15 years after his Oscar-winning turn in “Ray, ” still somehow seems underrated and underutilized. Johnny D provides a welcome reminder of how good he can be; he conveys the mans guardedness and his vulnerability, his kindness and his fury, with the smallest eye movements and vocal inflections, which makes the big emotional scenes all the more powerful. But its Morgan, as Herbert Richardson, another inmate awaiting execution, who leaves the deepest impression. Richardson, a Vietnam veteran, doesnt deny his guilt, and the mixture of remorse, terror and simple grief he feels as he contemplates his fate is heartbreaking. Morgan keeps doing remarkable work (in “Mudbound” and “The Last Black Man in San Francisco, ” as well as on the Netflix series “Stranger Things”) and he deserves a louder fanfare. I n an emotionally charged scene in the new movie Just Mercy, Jamie Foxx, cast as a death row prisoner named Walter McMillian, accosts the young lawyer who has taken up his case with an uncomfortable truth about being black in the deep south. “You dont know what youre into down here in Alabama, ” he warns. “Here youre guilty from the moment youre born. ” That phrase could stand as a catchphrase for the ingrained racial injustice that Bryan Stevenson, the rookie lawyer played in the film by Michael B Jordan, has devoted his adult life to fighting. From his first meeting with McMillian in 1988 to his star billing today as a one of Americas most incisive commentators on race and inequity ? and now as a fully fledged Hollywood icon ? Stevenson has never taken his eyes off the prize. His epic six-year struggle to prove McMillian an innocent man provides the narrative arc of Just Mercy. It is based on the 2014 memoir of the same name in which Stevenson, 60, relates how he came to find himself representing some of the most godforsaken prisoners in the country. He was 23 and a student at Harvard law school when his professor suggested he take an internship in Atlanta, Georgia, with a not-for-profit legal firm. The firms director, a towering figure in death penalty jurisprudence named Stephen Bright, took Stevenson under his wing and taught him justice, southern-style. Those existential doubts vaporised as soon as Bright dispatched Stevenson to Alabama to investigate its death row. “When Bryan started looking into what was down there, ye gods! It was horrible! ” Bright told the Guardian. “People were being sentenced to death in a perfunctory fashion represented by lawyers who had no idea what they were doing. ” Bright recalls his young charge returning from a prison visit in an excited state. “This man is innocent, ” Stevenson said. “I know he is innocent. ” The man in question was Walter McMillian who had been sentenced to death for the 1986 murder of an 18-year-old white woman. When Stevenson began looking into the case he was struck by a legion of inconsistencies and ironies. The main irony was that the murder happened in Monroeville, home town to Harper Lee, which just went to show how much Alabama had taken to heart the moral of To Kill A Mockingbird. Even before he got going on the case, the trial judge ? aptly named Robert E Lee Key ? tried to talk Stevenson out of it. “Why the hell would you want to represent someone like McMillian? ” the judge said. Undeterred, Stevenson began digging into the record and discovered that not only had McMillian been found guilty in a trial lasting all of two days, but the defendant had a rock-solid alibi with dozens of witnesses. The prosecution relied on a jailhouse snitch who was offered money and freedom to provide false testimony against him. Exposing the racial animus at the heart of the death penalty was not easy. There were bomb threats and many disappointments and legal setbacks along the way. But in 1993 McMillian was exonerated and walked free. Its a measure of the exceptional nature of Stevenson that just where the movie ends ? with the good guys winning their death row battle ? his own story begins to get all the more interesting. Stevenson has gone on, post-McMillian, to create an entire operation dedicated to uncovering miscarriages of justice in the deep south. Back in the 1980s he had a poky office and a single assistant; today the organisation he founded, Equal Justice Initiative, employs 140 people, many of them whip-smart lawyers in his own mould. EJI has won reversals or release from prison for more than 135 wrongly convicted prisoners. Among them was Anthony Ray Hinton, who like McMillian was proven innocent in his case after 28 years on death row. Having turned EJI into a justice powerhouse, Stevenson has switched his energies to what might well become the most significant aspect of his legacy. He is now emerging as a leading exponent of Americas racial fault-line in which he has begun to join the dots between slavery, racial segregation, terror lynchings of African Americans, capital punishment and the scourge of modern mass incarceration. He has taken his hands-on experience of southern brutality ? what he calls his “proximity to injustice” ? and extracted from it a philosophy of the open wound that runs through American society and politics. To do that he has drawn from his roots as the great-grandson of slaves in Virginia and his experiences growing up as a black child in a small, segregated town in rural Delaware. From regular attendance at his familys local black church he imbibed the preachers art of engaging an audience. You can see it in action in his Ted talk which has been viewed more than 6m times and which earned him one of the longest standing ovations in Teds history. Photograph: Brendan Gilliam/The Guardian Stevensons mission to join the dots began when he started thinking about the nature of public memorialising in Montgomery, the capital of Alabama where he set up base in the 1980s. He counted 59 Confederate markers glorifying the slave-owning south, while there was nothing to memorialise the suffering that the slave trade induced. In 2013, after a long tussle with local authorities, he managed to have three markers to the domestic slave trade erected in downtown Montgomery. From there it was but a short hop to thinking about the racial composition of death row. Why were Walter McMillian and Anthony Ray Hinton both black? Why are 42% of death row inmates today African American, when black people form just 13% of the US population? The culmination of these meditations is the National Memorial for Peace and Justice, Stevensons most breathtaking and audacious achievement yet. Through it he holds up a mirror to America of a central element of its character, one that until now has been almost entirely obscured ? its tragic history of lynchings of more than 4, 000 African Americans. The memorial, cast in bronze, sits on top of the hill that rises above Montgomery. Physically, and symbolically, it looks down on the Alabama State Capitol where so many of the political decisions that upheld white supremacy were taken ? and still are taken. Standing in the centre of the memorial the power of Stevensons unfolding vision is almost overwhelming. From Montgomerys slave warehouse and the thousands of men and women who died hanging from a tree, to Walter McMillian who came so close to a latter-day judicial lynching, this is Americas unfinished business, its truly strange and bitter fruit.

So in this scene in particular, there really is just the light source thats coming in from outside the jail cell, which gives this kind of amber hue. That is really going to be a big contrast to the moment when we go outside through Walter McMillians escape vision in his mind that takes him back to the moment in the beginning of the movie when he is out in the forest and looking up at the trees. To capture the performances of this scene, we actually shot with two cameras running simultaneously, with Jamie Foxx in one cell and Rob Morgan in the other? which was very helpful for a scene like this, because it was quite loose. And it allowed the two actors to really be in it and respond to each other. And both sides of the conversation were captured. Jordan, is a recent graduate of Harvard Law School who arrives in Alabama in the late 1980s with a quiet idealism that many of the locals ? both those who are hostile to his cause and those who support it ? take for naïveté. They gently and less gently suggest that as a native of Delaware with a northern education, he cant possibly understand the tenacity of white Southern habits of racial domination, which some of the white residents insist are not racist at all. McMillian himself, known to his family and neighbors as Johnny D (and played by Jamie Foxx) at first refuses Stevensons help. The injustice of his trial was so blatant that opposing it seems almost like a waste of time. Other lawyers have come and gone, taking money from Johnny Ds wife, Minnie (Karan Kendrick) and leaving him to languish on death row. The drama of “Just Mercy” is mostly procedural. Stevenson and his colleagues, including Eva Ansley (Brie Larson) work to establish Johnny Ds alibi and to challenge the testimony of a dubious witness (Tim Blake Nelson. Stevenson also runs up against the malevolent arrogance of the sheriff (Michael Harding) who led the investigation and the duplicity of the new district attorney (Rafe Spall) whose initial politeness turns to condescension and contempt. What is clear is that Stevenson isnt just challenging a single conviction, but also the deep legacies of slavery and Jim Crow. Like many of the lynching victims of the past, Johnny D threatened racial hierarchies, both because he was economically independent (owning a successful pulpwood business) and because of an affair he had with a white woman. His adultery is painful for Minnie and their children, and represents an unacceptable transgression of racial and sexual taboos to the sheriff and other white people. Jordan plays Stevenson as a man of heroic decency, but this kind of role comes with constraints. He is consistently admirable but not always dramatically interesting, and whatever fear, doubt or anguish he experiences in his work is telegraphed through speeches and music-heavy moments. His inner life is a territory the film leaves unexplored. “Just Mercy” is saved from being an earnest, inert courtroom drama when it spends time on death row, where it is opened up and given depth by two strong, subtle performances, from Foxx and Rob Morgan. Foxx, 15 years after his Oscar-winning turn in “Ray, ” still somehow seems underrated and underutilized. Johnny D provides a welcome reminder of how good he can be; he conveys the mans guardedness and his vulnerability, his kindness and his fury, with the smallest eye movements and vocal inflections, which makes the big emotional scenes all the more powerful. But its Morgan, as Herbert Richardson, another inmate awaiting execution, who leaves the deepest impression. Richardson, a Vietnam veteran, doesnt deny his guilt, and the mixture of remorse, terror and simple grief he feels as he contemplates his fate is heartbreaking. Morgan keeps doing remarkable work (in “Mudbound” and “The Last Black Man in San Francisco, ” as well as on the Netflix series “Stranger Things”) and he deserves a louder fanfare.
