インテリジェントデザイン宣伝映画"Expelled"におけるJohn Lennonの"Imagine"引用がフェアユースに該当するか否かの裁判で、"Expelled"制作側の弁護士Anthony T. Falzoneは、インテリジェントデザイン宣伝映画の主張は「宗教の欠落はファシズム・全体主義・ナチズムへの道を踏み固めることだ」と述べた。

Lawyer Anthony T. Falzone, for the film makers, said the portion of Imagine - "nothing to kill or die for, and no religion too" - was central to the movie.
He said the film's makers were criticising the "happy, naive feeling you get when you hear the song", saying that was "dangerously naive".

He said the movie suggests "that this absence of religion paves the way for fascism, totalitarianism, Nazism".

"Really, what the film is doing is, it's asking if John Lennon was right and it's concluding he was wrong," the lawyer told US District Judge Sidney Smith on Monday.

He also said the filmmakers did not believe they needed to ask Ono's permission because they didn't use enough of the song to violate the copyright.

"Why would you ask somebody for permission to criticize their work?" he asked. "It's not likely it's going to be granted."

映画製作会社のCEOは、"Imagine"は宗教をなきものにしようとするダーウィニストの主張そのものだと指摘する。

“If you really listen to the lyrics of ‘Imagine’ then you realize that it represents everything that the neo-Darwinists want. ‘Imagine there’s no Heaven … No hell below us … Nothing to kill or die for And no religion too…’ That’s exactly what the Darwinist establishment wants to do: get rid of religion,” said Walt Ruloff, CEO of Premise Media. “And that’s what we point out when we play less than 15 seconds of the song and show some of the lyrics on screen.”

彼らの用法では、ダーウィニズムはもはや進化論ではなく、反宗教のことのようだ。そして、宗教の擁護者として、ダーウィニズムと戦っているようだ。
