Montana House Bill 418

A BILL FOR AN ACT ENTITLED: "AN ACT STATING MONTANA'S POSITION ON CLIMATE CHANGE; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

WHEREAS, the Intergovernmental Panel on Climate Change claims human carbon dioxide emissions have caused all the increase in atmospheric carbon dioxide since 1750, or above 280 parts per million; and

WHEREAS, all Intergovernmental Panel on Climate Change arguments to prove claims of increases in atmospheric carbon dioxide have failed; and

WHEREAS, a simple physics model proves human carbon dioxide emissions contribute less than 5% to the level of atmospheric carbon dioxide and nature contributes more than 95% to the level of atmospheric carbon dioxide; and

WHEREAS, the human contribution of less than 5% is far too little to cause the Intergovernmental Panel on Climate Change's claimed climate change; and

WHEREAS, nature's contribution of more than 95% can be the only cause of the Intergovernmental Panel on Climate Change's claimed climate change; and

WHEREAS, if all human carbon dioxide emissions could be stopped, the resulting reduction in atmospheric carbon dioxide would be less than 18 parts per million of the present 410 parts per million, and therefore would not be enough to change nature's relentless increase in atmospheric carbon dioxide; and

WHEREAS, the physics model accurately simulates the decay of carbon-14 carbon dioxide in the atmosphere, following the cessation of the atomic bomb tests, from 1970 to 2014; and

WHEREAS, the Intergovernmental Panel on Climate Change model cannot simulate the decay of carbon-14 from 1970 to 2014; and

WHEREAS, the scientific method requires the rejection of all theories that make incorrect predictions; and

WHEREAS, the reduction of the balance level of carbon-14 and carbon-13 caused by human emissions shows the physics model is correct, and the Intergovernmental Panel on Climate Change model is incorrect; and

WHEREAS, the carbon-14 data shows that the Intergovernmental Panel on Climate Change claim that human emissions have decreased the "buffer capacity of the carbonate system" is an invalid claim; and

WHEREAS, the Intergovernmental Panel on Climate Change model assumption that nature treats human carbon dioxide and natural carbon dioxide differently is an invalid assumption that violates physics; and

WHEREAS, the National Climate Assessment makes the same errors as the Intergovernmental Panel on Climate Change, and the National Academy of Sciences is also fundamentally wrong about climate change.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

NEW SECTION. Section 1. Public policy concerning climate change. (1) The legislature finds that it is necessary to adopt a public policy regarding climate change.

(2) The legislature finds:

(a) reasonable amounts of carbon dioxide released into the atmosphere have no verifiable impacts on the environment;

(b) science shows human emissions do not change atmospheric carbon dioxide emissions enough to cause climate change;

(c) claims that carbon associated with human activities causes climate change are invalid; and

(d) nature, not human activity, causes climate change.

(3) The legislature further finds:

(a) when providing educational and informational materials on climate change, the findings in subsection (2) should be offered; and

(b) tax incentives with an underlying intent to alter human behavior in response to climate change should be discouraged, are unnecessary, and represent an inappropriate use of limited state resources.

(4) On or before September 15 of even-numbered years and in accordance with 5-11-210:

(a) the superintendent of public instruction shall provide a report to the education interim committee regarding climate change curriculums offered in Montana's public schools;

(b) the commissioner of higher education is requested to provide a report to the education interim committee regarding climate change curriculums taught in Montana's public universities; and

(c) the department of revenue shall provide a report to the revenue and transportation interim committee on the use of tax incentives intended to alter human behavior in response to climate change, including but not limited to the use of tax credits provided in accordance with 15-30-2319, 15-31-124, 15-32-109, 15-32-201, and 15-32-402; tax deductions provided in accordance with 15-32-103; and other related tax incentives included in 15-6-157, 15-6-224, 15-6-225, and 15-24-3111.

NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an integral part of Title 75, chapter 2, and the provisions of Title 75, chapter 2, apply to [section 1].

NEW SECTION. Section 3. Effective date. [This act] is effective on passage and approval.
